The only way that checkbox would prevent bots is through javascript unless Google has found some new, revolutionary, javascript+non-javascript solution. Doubtful though. We'll have to wait and see, good find.

Looks like it also analyzes user footprint, that means a not-logged in user gets more difficult captcha. Plus it uses timeouts as far as I can see.

Haha ya, I sent @sven this captcha a while back when they had it on their website and he checked it out and I'm pretty sure mentioned it used javascript.
On all of my sites I drop or redirect visitors that disabled js, just because it's probably bots (I allow known bots) or people that sneak something.
And it's less than 1% of my traffic volume.

Haven't seen one in the wild yet, and I suspect that 90%+ of webmasters won't bother to update the code on their existing sties.
